AI Body Editor, its subsidiaries and affiliated companies provide this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of information we receive from users of (i) the website located at https://aibodyeditor.web.app (the “Site”), including any services, features, and content accessible or downloadable from the Site, and (ii) any other AI Body Editor application, service, or product licensed, downloaded, or otherwise accessed by such users through third-party websites or sources ((i) and (ii) collectively, the “Service”).

Acceptance and Consent

By registering for a user account that enables you to post to the Forums (the “Account”), and/or using the Service, you agree to the terms and conditions of this Privacy Policy, and you consent to the collection, use, and disclosure of your information by AI Body Editor in accordance with the terms and conditions of this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, please do not provide us with any information and do not use the Service.

Changes to the Privacy Policy

AI Body Editor reserves the right, in its sole discretion, to change or modify this Privacy Policy at any time by posting the changed or modified version of the Privacy Policy on the Site. Any such changes or modifications will be effective immediately upon posting. If we make any changes to this Privacy Policy, we will change the Last Revised date below.

Information Collection and Use

Our primary goals in collecting and using information are to provide and improve the Service, to administer and assist you in administering your Account on the Service, and to provide you with a better experience with the Service. We store and process information in the United States.

Personal Information and Non-Personal Information

AI Body Editor may collect personal and non-personal information from you when you use the Service. Personal information is information that specifically identifies an individual, including, but not limited to, an individual’s name, phone number, credit card or other billing information, email address, and home address. This Privacy Policy in no way limits or restricts our collection of aggregate or anonymous information. In this Privacy Policy, we refer to all information collected from or about you, including personal information and non-personal information, as “Your Information.”

Use of Account

We may collect Your Information, including your email address, in connection with your creation of an Account. You can register for an Account via an AI Body Editor application. Certain of Your Information, such as your username and other information, may always be publicly visible by other users of the Forums, including when such users view your Account profile page. Your email address will not be publicly visible unless you choose to make it visible on your Account profile page. When you register for an Account or later access your Account, you may be able to adjust settings and preferences within your Account to choose whether to share and make publicly visible other pieces of Your Information, and the Service may display Your Information based on the settings and preferences you choose.

We encourage you to consider carefully what information to share as part of your Account profile and elsewhere in the Service, and we recommend that you guard your anonymity and sensitive information and not use your real name as your username, as that may allow other users of the Service to identify you. Any information you choose to share should reflect how much you want other users of the Service to know about you. You can review and revise your Account profile information at any time.

We may also request and collect Your Information when you administer or personalize your Account after registration or otherwise interact with the Service. For example, we may collect Your Information both when you enter promotions on or in connection with the Service as well as in connection with your transactions (such as, but not limited to, donations or the purchase of products) through the Service or with AI Body Editor’s advertisers. Such transaction-related information may include payment information, such as information regarding your account with an online payment service provider, and information about your use of products and services offered by our advertisers.

Use of Applications

When you launch any of our applications, we collect information regarding your device type, operating system and version, carrier provider, IP address, Media Access Control (MAC) address, International Equipment Mobile ID (IMEI), whether you are using a point package, the game version, the device’s geo-location, language settings, and unique device ID. In addition, we create a unique user ID to track your use of our Service. This unique user ID is stored in connection with your Account profile information to enable us to move Your Information to a new device at your request. In addition, it may be used to link a character with which you play our games to your username on the Forums. When you play our games, we also collect information about your play and interaction with other users and the Service.

We may collect Your Information, such as your name or email address, from third-party websites or other sources from which you download or access AI Body Editor applications, services, or products that also make up part of the Service.

We use Your Information to provide the Service, to attempt to provide you with a better experience, to improve the quality and value of the Service, and to analyze and evaluate how the Service is used. We may also use Your Information to serve you specifically, for instance, by delivering products or advertisements to you according to your preferences or restrictions. We may also use Your Information to contact you with communications such as AI Body Editor newsletters, marketing or promotional materials, and other information that may be of interest to you.

SMS Notifications & Push Notifications

We receive and store the information you provide, including your telephone number, when you sign up to have SMS notifications sent directly to your mobile device. These messages notify you of in-game activity and may allow you to play the game from your phone. With your consent, we may send push notifications to your mobile device to provide game updates and other relevant messages.

Communications Features

You may be able to take part in certain activities in our applications that give you the opportunity to communicate or share information with AI Body Editor and other users of our Service. These include:

We may record and store archives of these communications. You acknowledge and consent to the recording and storage of such communications.

Log Data, Cookies, and Web Beacons

When you browse certain portions of the Service, we may automatically collect and record standard user information and clickstream data about your visit (through the use of cookies and otherwise) as part of our analysis of the use of the Service. For example, when you visit or request a web page from our server, we may record the IP address of the user’s machine, the time, date, and URL of the request and information about the browser being used, and other information regarding the visit, such as the pages visited on the Service, the time spent on each page, any advertisements clicked, and any search terms used (collectively, “Log Data”).

We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of AI Body Editor or any third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical, or legally actionable.

We may share aggregate or anonymous information about you with advertisers, publishers, business partners, sponsors, and other third parties.

Social Network Connect

If you use one of our applications and connect to your social network account, such as Facebook, Twitter, Vine, Instagram, YouTube, and so on, within such application, you will be providing us with basic account information i.e., user ID, name, email, gender, birthday, current city, profile picture URL, and the user IDs of your friends who have also connected with our applications. In addition, we will cache data we receive from the Social Network’s APIs to improve our user experience. Offer Wall

We may display an “offer wall” in our applications that is hosted by an offer wall provider. The offer wall allows third-party advertisers to provide virtual currency to users in exchange for interacting with an advertisement or for completing a marketing offer that may include signing up for an account with one of those advertisers. These are not offers made by AI Body Editor. These offers may be displayed to you based on certain technical information, such as your geographic area or anonymous demographic information. After clicking on one of these advertisements, you will no longer be on a site hosted by AI Body Editor. To properly credit user accounts and to prevent fraud, a unique identifier, will be shared with the offer wall provider.

Invite a Friend

You may decide to provide us with another party’s email address to allow us to contact and invite that party to visit or join the Service or so that AI Body Editor may facilitate your communication with such other party through methods of communication enabled by the Service (such as when you upload an address book). Such email addresses will be used only for the purpose of sending email communications to the addressee.

Forums

AI Body Editor may at times offer you the ability to post content to a blog, message board, chat room, or within AI Body Editor’s applications or other forums (“Forums”). In order to do so, you may be required to provide personal information. You should be aware that any visitor to the Forum may read your postings on the Forum.

Furthermore, any information that you may post to a Forum, including your username or other Account profile information, will be disclosed and available to all users and viewers of that Forum, and will therefore no longer be private. AI Body Editor cannot guarantee the security of such information that is disclosed or communicated online in public areas such as the Forums, and you provide such information at your own risk. AI Body Editor does not author, edit, endorse, or monitor any Forum. You acknowledge and agree that AI Body Editor has no responsibility for the accuracy or availability of information provided on any Forum. AI Body Editor reserves the right at any time, in its sole discretion, to remove any content that a user may post on any Forum and restrict their access to any Forum.

Security

AI Body Editor takes reasonable measures to protect your information from unauthorized access or against loss, misuse, or alteration by third parties.

Although we make good faith efforts to store the information collected on the Service in a secure operating environment that is not available to the public, we cannot guarantee the absolute security of that information during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining access to this information. We do not warrant or represent that your Account or any of Your Information will be protected against loss, misuse, or alteration by third parties.

Information Transfers

AI Body Editor reserves the right to transfer Your Information in connection with a change or transfer of AI Body Editor’s ownership or a merger, acquisition, reorganization, or sale of assets or in the event of bankruptcy.

International Users

If you are located outside the United States and choose to provide information to us, AI Body Editor transfers Your Information to the United States and processes it there. You hereby consent to any such transfer.

Third Party Links

The Service may contain links to other websites and online services (“Linked Sites”). The fact that we link to a third-party website or service is not an endorsement or representation of our affiliation with that third party, nor is it an endorsement of their privacy policies or practices. You acknowledge and agree that we are not responsible for the privacy practices of such Linked Sites, and this Privacy Policy does not apply to such Linked Sites. The operators of Linked Sites may collect information about you, and may use and disclose that information. We encourage you to review the privacy policies of the Linked Sites that you use.

Opt-In and Opt-Out Policy

We will not share your personal information in ways other than as described in this Privacy Policy unless you specifically elect to make your personal information available to third parties by selecting to “opt-in” in various places on the Service. Your “opt-in” elections will not, however, require us to share your personal information with any third parties. Our Policy Regarding Children

The Service is not directed to children under the age of 13. We do not knowingly collect or solicit personally identifiable information from children under 13. If you are under 13, please do not attempt to register for an Account on the Service or send any information about yourself to AI Body Editor. If we become aware that a child under 13 has provided us with personal information, we will delete such information from our files.

Terms of Condition

AI Body Editor offers a web and mobile application that automatically edits and produces videos using proprietary technologies. Our website is located at https://aibodyeditor.web.app (the “Site”). AI Body Editor is owned and operated by AI Body Editor, Ltd. (hereafter “AI Body Editor”, “us”, “our”, “we”). These Terms of Service (“Terms”) govern your access and use of the Site, the AI Body Editor mobile software application (the “Application”), and all services available through the Site and the Application (collectively, the “Services”). “You” or “Your” means an adult user of the Services, or as the parent or guardian of any minor whom you allow access to the Services, and for whom you will be held strictly responsible.

Acceptance and Consent

By downloading the AI Body Editor mobile software, registering to use the Application, or otherwise accessing the Application on a local device or remote device or server, you may be eligible to use any of the Services. Any information that you supply to us will be governed by these Terms and the Privacy Policy as they may be updated from time to time by us. You agree to abide by the rules and policies established from time to time by us. Such rules and policies will be applied generally in a nondiscriminatory manner to all users of the Services.

AI Body Editor does not accept registration from users who are under 13 years of age, in compliance with the Children’s Online Privacy Protection Act of 1998. By visiting and contributing to content on AI Body Editor, you attest that you are at least 13 years old.

Changes to the Terms

AI Body Editor reserves the right to change, update, or cease to offer the Site, the Application, or any part thereof at any time. Any changes to these Terms will be effective immediately upon posting. Your continued use of the Site and/or the Application will be deemed acceptance of any amended or updated terms. If you do not agree to any of these Terms, please do not use the Site and/or the Application.

Account Registration

When you complete the registration process, you create an account and become a member. Your account allows you to participate in certain services provided through the Services, subject to the Terms and the Privacy Policy. AI Body Editor reserves the right to refuse to allow a user to open an account for any reason or to limit the number of accounts a user can establish through the Services, all at AI Body Editor’s sole discretion.

To create an account, you must select a username and password. Your username is your AI Body Editor identity. You may not select a username that is used by someone else, and your username cannot be indecent or otherwise offensive, or be used in any way that violates the Terms and common practices. You may not provide false information during the registration process. You must provide truthful and accurate information while creating your account.

Maintaining Account Security

Maintaining account security is very important. You should not reveal your password to anyone. AI Body Editor will not ask you to reveal your password. If you forget your password, you can request to have a new password sent to your registered email address. Accounts are registered to you personally and may not be sold, traded, gifted, or otherwise transferred at any time under any circumstances. Your account is at risk if you let someone use it inappropriately, and your account is subject to termination if you or anyone using your account violates the Terms. If your account is terminated, you may not join AI Body Editor again without express permission.

You agree to immediately notify AI Body Editor of any unauthorized use of your AI Body Editor account or password. You are fully and solely responsible for the security of your computer system and all activity on your account, even if such activities were not committed by you. AI Body Editor will not be liable for any losses or damage arising from unauthorized use of your account or password, and you agree to indemnify and hold AI Body Editor harmless for any improper or illegal use of your account, including any mail sent and any charges and taxes incurred, unless you have notified us on https://aibodyeditor.web.app that your account has been compromised, and have requested us to block access to it. This includes illegal or improper use by someone to whom you have given permission to use your account.

Billing for Commercial Use

If you sign up for a package that allows for commercial use of the Services, you will be able to choose between a Business Package and a Marketers Package (each a “Commercial Use Package”) and shall be allowed to use Content created using such Commercial Use Package for limited commercial use as set forth under the section entitled “Intellectual Property & Content.” Users of Commercial Use Packages will be referred to as “Commercial Users”. All other users, who may access the Services solely for their own Personal Use, will be referred to as “Personal Users”. Personal Users shall be allowed to use Content created using such Personal Use Package for limited Personal Use as set forth under the section entitled “Intellectual Property & Content”.

Basic Personal Users generally use the Services without charge but may in some circumstances pay for some aspects of the Services. Premium Personal Users shall pay in accordance with the fees set forth on the Site. Personal Users may upgrade to a Commercial Use Package by signing up for a Commercial Use Package.

Current fees for Commercial Use Packages are as set forth on the Site. All fees paid are nonrefundable. By signing up for a Commercial Use Package and providing your billing information, you are authorizing us to charge your designated payment method on a recurring basis. Your subscription for a Commercial Use Package may start with a free trial. The free trial period of your subscription lasts for the period specified during sign-up. If at the end of the free trial period, you wish to continue use of the Commercial Use Package, we will ask you to provide your billing information and charge your designated payment method on a recurring basis. Free trials are for new and certain former users only. AI Body Editor reserves the right, in its absolute discretion, to determine your free trial eligibility.

Unless you cancel your subscription in the “Billing” section of your account settings or notify us of your decision to cancel, your subscription will automatically renew at the then-current fee. AI Body Editor may, from time to time, modify, amend, or supplement its pricing and billing procedures, and such changes shall be effective immediately upon posting an update of these Terms or posting such changes elsewhere on the Site. If you do not accept the new changes, you should terminate your subscription immediately.

A Commercial Use Package is valid for only one single end user. Accounts are registered to you personally and may not be sold, traded, gifted, or otherwise transferred at any time under any circumstances. You may not share your account. You may not disclose your password to anyone else. If you have registered for a Commercial Use Package on behalf of your employer, please note that each end user of a Commercial Use Package must register for his or her own account.

Termination of Account

You agree that AI Body Editor may, for any reason, in its sole discretion and without notice, terminate your account and remove from the Services any Content associated with your account. Grounds for such termination may include (i) past due payment, regardless of the amount, (ii) extended periods of inactivity, (iii) violation of the letter or spirit of these Terms, (iv) fraudulent, harassing or abusive behavior, (v) behavior that is harmful to other users, third parties, or the business interests of AI Body Editor, or (vi) if, under appropriate circumstances, the user is determined by AI Body Editor to be a repeat infringer of intellectual property rights. If AI Body Editor terminates your account for any of the foregoing reasons, you shall not be entitled to any refund of fees paid with respect to such account. You agree to pay any outstanding balance in full within seven (7) days of termination of your account.

If AI Body Editor believes, in its sole discretion, that a violation of these Terms or any illegal or inappropriate behavior has occurred, we may take any other corrective action we deem appropriate. We reserve the right to investigate suspected violations of these Terms or illegal and inappropriate behavior on the Services. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone believed to have violated these Terms or to have engaged in illegal behavior on the Services.

You may request termination of your AI Body Editor account at any time and for any reason by contacting us on https://aibodyeditor.web.app. Any suspension, termination, or cancellation shall not affect your obligations to AI Body Editor under these Terms (including but not limited to ownership, intellectual property, indemnification, and limitation of liability), which by their sense and context are intended to survive such suspension, termination, or cancellation. Premium Fees and fees paid in advance for Commercial Use Packages are not refundable, and AI Body Editor shall not refund any such fees if you request to terminate your account. YOU ACKNOWLEDGE AND AGREE THAT ANY APPLICABLE FEES AND OTHER CHARGES ARE NON-REFUNDABLE IN WHOLE OR IN PART. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR ACCOUNT, INCLUDING ANY UNAUTHORIZED CHARGES.

Intellectual Property & Content

AI Body Editor and its licensors own the Services, including all worldwide intellectual property rights in the Services, and the trademarks, service marks, and logos contained therein. If you are a Personal User, AI Body Editor hereby grants you a limited, revocable, personal, worldwide, royalty-free, non-exclusive, non-sublicensable, and non-assignable license to use the applicable (Basic or Premium) Services solely for your Personal Use. Except as expressly permitted herein, Personal Users may not copy, further develop, reproduce, republish, modify, alter, download, post, broadcast, transmit or otherwise use the Services.

If you are a Commercial User, AI Body Editor also hereby grants you a limited, revocable, personal, worldwide, royalty-free, non-exclusive, non-sublicensable, and non-assignable license to use the Content created using your Commercial Use Package for any legitimate business purpose, including, without limitation, selling videos created through the Service (“Videos”) online and offline (whether through an e-commerce website or directly to a customer in electronic or tangible form, such as on a DVD), posting, distributing, or otherwise monetizing such Videos online, and incorporating such Videos into other works, such as television advertisements, all subject to and in accordance with the terms specified herein.

During the term of these Terms, Commercial Users may use the Services to produce Videos for: (i) their own internal commercial use; or: (ii) the commercial use of one specific third party; or (iii) the use of more than one specific third party, provided however that in such event the Commercial User must by contract limit the right of such third parties to use the Video for their own Personal Use only. You will not remove, alter, or conceal any copyright, trademark, service mark, or other proprietary rights notices incorporated in the Site, Services, or any Content, except as AI Body Editor may expressly permit.

User Submissions

You are solely responsible for Submissions you post or transmit to the Services. “Submissions” is defined as anything a user transmits to the Services or to another in the course of using the Services, including without limitation any raw video or audio material. You represent and warrant that you are the owner of all Submissions and have all legal right and authority to grant AI Body Editor the license set forth herein.

AI Body Editor does not claim ownership of your Submissions. However, by sending any Submissions you automatically grant AI Body Editor a worldwide, non-exclusive, royalty-free, sublicensable, and transferable perpetual license of all worldwide rights to use, edit, modify, include, incorporate, adapt, record, perform, display, and reproduce Submissions including, without limitation, all trademarks associated therewith, in any manner whatsoever, in or out of context, in all languages, in all media now known or hereafter created, including without limitation, for the purpose of improving and/or commercially promoting AI Body Editor and/or the Services.

Premium Content

AI Body Editor, in its sole discretion, may choose to provide users with “Premium Content”. The purchase of Premium Content shall be subject to the payment of fees to AI Body Editor, which may determine from time to time in its sole discretion (“Premium Fees”).

If you elect to pay for any Premium Content on a monthly recurring basis, you are authorizing us to charge your designated payment method on a recurring basis. You may update any of your billing information (including a change to your desired billing payment method) through your account settings on the Site. Unless you cancel your subscription in the “Billing” section of your account settings or notify us of your decision to cancel, your subscription will automatically renew at the then-current fee.

Use Restrictions

The software and technology underlying the Services is the property of AI Body Editor, and you may not connect to or use the Site and/or the Application in any way that is not expressly permitted by these Terms. Specifically, you may not do or attempt to do any of the following:

Disclaimer

Your use of any aspect of the Site and/or the Application is at your own risk. AI Body Editor makes no representations or warranties whatsoever in respect of the Services or Content. Neither AI Body Editor nor any of its affiliates will be liable for any direct, incidental, consequential, indirect, punitive, exemplary, special, or other damages, whether under any contract, tort (including negligence), strict liability, or other theory, and regardless of whether it has been advised of the possibility of such claim or damage, arising in connection with the Services, Submissions or Content. AI Body Editor cannot accept any liability whatsoever in respect of any Video and/or Content which is modified by you or any other third party.

Limitation of Liability

In no event shall AI Body Editor be liable to you or any third party for any damages, including but not limited to general, incidental, consequential, indirect, direct, special, or punitive damages, arising out of or relating to the Services or Content. In any case, AI Body Editor’s entire liability under any provision of this agreement shall not exceed amounts paid by you to AI Body Editor for the use of the Services and Content hereunder. As such, if you have not made any payments to AI Body Editor for the use of the Services, AI Body Editor shall have no liability to you whatsoever, with the exception of death or personal injury caused by negligence of AI Body Editor to the extent applicable law prohibits the limitation of damages in such cases.

Indemnification

You agree to indemnify, defend, and hold harmless AI Body Editor and the respective employees, directors, officers, subcontractors, and agents of each, against any and all claims, damages, or costs or expenses (including reasonable attorneys’ fees) that arise directly or indirectly from: (a) breach of these Terms by you or your employees or agents or anyone using your computer, device, or password; (b) any claim, loss, or damage experienced from your or your employees’ or agents’ use or attempted use of (or inability to use) the Services, including any transactions that you or your employees or agents conduct or attempt; (c) your or your employees’ or agents’ violation of any law, ordinance, rule, regulation, or treaty; (d) your or your employees’ or agents’ infringement of any right of any third party, including without limitation the infringement by any Submissions of any third party intellectual property right or moral right; (e) your or your employees’ or agents’ violation of any applicable law, regulation, rule or third-party intellectual property right or moral right as a result of your or your employees’ or agents’ forwarding, posting, or use of any Content; (f) any Content that you or your employees or agents downloaded from the Services or modified; and (g) any other matter for which you or your employees or agents are responsible hereunder or under law.

Binding Arbitration

You and AI Body Editor agree that, except as provided below, all disputes, controversies, and claims related to these Terms (each a “Claim”), shall be finally and exclusively resolved by binding arbitration. The arbitration will be conducted under the Streamlined Arbitration Rules and Procedures of JAMS that are in effect at the time the arbitration is initiated (the “JAMS Rules”) and under the terms set forth in these Terms. In the event of a conflict between the terms set forth herein and the JAMS Rules, the terms herein will control and prevail.

The arbitration will be conducted in San Francisco, California, unless the parties agree to video, phone, and/or internet connection appearances. You and AI Body Editor agree that any arbitration shall be limited to the Claim between AI Body Editor and you individually.

Severability

You and AI Body Editor agree that if any of the arbitration provisions are found illegal or unenforceable (except any portion under the “Exceptions to Arbitration” section), only those provisions that are found illegal or unenforceable shall be severed and the remainder of the provision shall be given full force and effect. If the provisions under the “Exceptions to Arbitration” section are found to be illegal or unenforceable, then neither you nor AI Body Editor will elect to arbitrate any Claim falling within those provisions found to be illegal or unenforceable, and such Claim shall be exclusively decided by a court of competent jurisdiction within the County of San Francisco, California.

Miscellaneous

These Terms shall be governed by the laws of the State of California exclusive of its choice of law rules. Any action to be brought in connection with these Terms or the Services shall be brought exclusively in the state and federal courts located in San Francisco, CA, and you irrevocably consent to their jurisdiction. In any action to enforce this Agreement, the prevailing party will be entitled to costs and attorneys’ fees.
